Following the COVID-19 outbreak and the stresses being placed on the global economy, the need for businesses to protect their competitive advantages may never have been greater โ intellectual property is a key component of this for many companies.
Against this backdrop, in the British Chamber's 2019 Position Paper (which can be found here), British businesses called on the Chinese government to further address long-standing issues relating to the protection of companies' patents and trademarks, as well as the inconsistent enforcement of IP rights across the country. However, with new IP protections found in the amended Trademark Law and the new Foreign Investment Law, both launched in the last six months, and further proposed amendments to the Patent Law and other reform measures being drafted, there is also acknowledgement of the continued efforts of the Chinese authorities to improve IP rights for foreign firms, with concrete progress seen in more stringent penalties for sellers of counterfeit goods and measures to strengthen the protection of trade secrets.
In the context of the UN-endorsed World IP Day on 26 April, the Chamber's Legal & Compliance Committee will invite Fabio Giacopello, Senior Partner at HFG Law & Intellectual Property, to give an update on the current legal and regulatory environment for intellectual property protection in China โ especially in relation to British and other foreign businesses looking to enter the Chinese market or enhance their existing IP practices here.
Through a presentation and an interactive Q&A session, this webinar will seek to explore what companies need to know, make predictions on the impact of COVID-19 on pharma and other patents and IP rights in China, and set out some best practice and pragmatic advice on IP strategy amidst the evolving uncertainty and regulatory reforms.
