Join BritCham's Education Committee for our third webinar this year. This time we will discuss how to address conflicts with Chinese partners in context of the education environment in China.
We invite Mark Schaub, Senior Partner at law firm King & Wood Mallesons, to share his experiences and lessons learned. The webinar will focus on his common-sense approach to conflicts including:
- "The Contract" โ knowing the role and limitations of your contract before engaging in dispute
- Choice of law โ most UK schools choose UK law, which is largely worthless in China unless the Chinese party has assets there
- Enforcement โ Chinese courts very unlikely to enforce UK court decision; generally introduce Chinese court and arbitration bodies
- Alternative resolution tactics beyond the legal โ most people in crisis tend first instinct is relying on contract and courts and not commercially/practically
