Join this online session to gain an improved understanding of employer/employee rights under the current circumstances โ€“ especially in relation to foreign employees. Speakers will define legal obligations and prerogatives contrasted with corporate best practice for duty of care and business continuity. Speakers will also share practical actions and advice that participants can act on immediately.

Following further restrictions on travel into China in anticipation of a worsening situation abroad due to the COVID-19 outbreak, many expatriates are now stranded in their home or a third country for an undefined period.

 

Almost overnight, key managers of China businesses are stuck and underperforming in the wrong time zone; global events are having a direct impact on who is available for class when the schools go back - can recalled teachers still overseas be replaced? How should employers react to families divided by international restrictions on movement? What rights do foreign nationals have and are they different from those of Chinese employees? What will be the lasting impact of decisions taken today on a company's brand and reputation from a hiring and retention perspective?

 

In a discussion facilitated by Alex Roberts, co-chair of BritCham Shanghai's Legal & Compliance Committee​, Jeffery Wilson, council of JunHe LLP's employment law practice, and Michael Hickman, former lawyer and Control Risks consultant on business continuity and duty of care issues, will explore how companies should (and shouldn't) treat China-based employees who are foreign nationals, trying to answer questions such as those above as well as others posed by participants of this webinar. Jeffery and Michael will discuss the legal limits and implications for employers and employees, overlaid by best practice and pragmatic advice in the evolving uncertainty.
